This is an English translation provided for convenience. In case of any discrepancy, the Polish version of these Terms available at simbuild.pl/regulamin prevails.

§1. General provisions

  1. The SIMBUILD online store available at simbuild.pl is operated by:

  2. These Terms set out the rules for using the Store, placing orders, concluding sales contracts, delivery, payments, withdrawal from the contract and complaints.
  3. Placing an order requires acceptance of these Terms.
  4. The Store sells sim racing accessories manufactured using additive manufacturing, via the Internet.

§2. Definitions

  • Seller – the entity indicated in §1(1).
  • Customer – a natural person, legal person or organisational unit making a purchase in the Store.
  • Consumer – a Customer who is a natural person making a purchase not directly related to their business or professional activity.
  • Order – the Customer's declaration of intent aimed at concluding a sales contract.
  • Product – goods available in the Store.
  • Cart – the Store software component enabling an Order to be placed.

§3. Using the Store

  1. Using the Store requires a device with Internet access and a web browser.
  2. The Customer may create an Account by providing an e-mail address and a password. The Account allows order tracking and access to purchase history.
  3. The Customer undertakes to provide true and accurate data.
  4. Using the Store in a way that infringes the law or third-party rights is prohibited.

§4. Placing orders

  1. Information about Products published in the Store constitutes an invitation to conclude a contract within the meaning of Article 71 of the Polish Civil Code.
  2. To place an Order you should:
    a) choose a Product and add it to the Cart,
    b) provide shipping and contact details,
    c) choose a delivery and payment method,
    d) confirm the Order by clicking “Place order”.
  3. The sales contract is concluded when the Seller confirms the Order (confirmation e-mail).
  4. Product prices shown in the Store are gross prices (VAT included). Prices are set in Polish zloty (PLN). For orders shipped outside Poland, prices and shipping costs may be displayed and charged in euro (EUR), converted at the exchange rate currently used by the Store.

§5. Payments

  1. The Store offers the following payment methods:
    a) online card payment (Visa, Mastercard) – handled by Stripe,
    b) cash on delivery (available for deliveries within Poland only).
  2. The online payment operator is Stripe, Inc., based in San Francisco, USA.
  3. For online payments, the Order is processed after payment confirmation is received.
  4. For cash on delivery, the Order is processed immediately after it is placed.

§6. Delivery

  1. Delivery is available within Poland and to selected countries listed at checkout.
  2. Order processing takes from 2 to 7 business days from Order confirmation (or from payment being credited in the case of online payment). International transit time is added on top of that.
  3. Delivery costs are shown during checkout and depend on the selected delivery method and destination country.
  4. Delivery methods within Poland:
    a) courier – PLN 15.99,
    b) InPost parcel locker – PLN 12.99,
    c) personal pickup – PLN 0.00 (by prior arrangement).
  5. For deliveries outside Poland a single international shipping option is available; its price is shown in euro at checkout.
  6. The Seller is not liable for delivery delays caused by the carrier.
  7. For deliveries outside the European Union, any customs duties, import taxes and clearance fees are borne by the Customer.

§7. Withdrawal from the contract (returns)

  1. A Consumer has the right to withdraw from the contract within 14 days of receiving the Product, without giving a reason.
  2. To exercise this right, the Consumer should inform the Seller of their decision by e-mail at [email protected] or in writing.
  3. The Consumer must return the Product without undue delay and no later than 14 days from the date of withdrawal.
  4. The cost of returning the Product is borne by the Consumer.
  5. The Seller refunds all payments received, including delivery costs (except additional costs resulting from choosing a delivery method other than the cheapest one offered), no later than 14 days from receiving the withdrawal statement.
  6. The refund is made using the same payment method that the Consumer used.
  7. The Product should be returned undamaged, in its original packaging.

§8. Complaints

  1. The Seller is obliged to deliver a Product free from defects.
  2. If a defect is found, the Customer may file a complaint under statutory warranty rules (Polish Civil Code).
  3. Complaints can be submitted by e-mail at [email protected] or via the contact form in the Store.
  4. A complaint should include: a description of the defect, the date it was discovered, the Customer's request (repair, replacement, price reduction or withdrawal from the contract) and proof of purchase.
  5. The Seller will consider the complaint within 14 days of receiving it.

§9. Personal data

  1. The controller of Customers' personal data is the Seller indicated in §1.
  2. Personal data is processed in order to fulfil Orders, in accordance with the Privacy Policy available at simbuild.pl/en/polityka-prywatnosci.
  3. Providing personal data is voluntary but necessary to fulfil an Order.

§10. Final provisions

  1. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
  2. The Seller reserves the right to amend these Terms. Amendments take effect upon publication in the Store.
  3. Any disputes will be settled by the court competent for the Seller's registered office, subject to Consumers' statutory rights.
  4. Consumers may use out-of-court complaint and redress procedures, including the ODR platform: https://ec.europa.eu/consumers/odr.
